What is of major importance is to understand that there are now two totally separate fields, mold assesors (inspectors) and mold remediators. Doing both is a conflict of interest (and now illegal in New York.) The reason this law was passed is that remediation companies were going into houses and businesses, and without testing, or doing their own rigged tests, determining that it there was a terrible mold problem, and then get an expensive clean-up job. Some were even coming for free in order to get a foot in the door for a profitable abatement job.

At times there was really not any mold problem in the first place! Other times, there may have actually been a problem, but the remediation contractor was not properly trained to detect it. At other times, when the remediator did the cleaning, sometimes they would do an incomplete job missing entire areas that were full of mold. They would also overcharge for their services since clients had no guidelines as to what this process should cost

New York State came to the conclusion that licensing was needed to protect the consumer from fraud and shoddy work because mold can cause many serious diseases. They decided to institute a system of checks and balances by creating two distinct professions: mold assessor and mold remediator. No person or company is now permitted to do both.

The Mold Inspection Process

The first process is to have a mold inspector such as us come in and test for mold. Our representative will take air samples and if visible particulate is found that looks like it could be mold, we will take swab samples of it. He will then send it to a laboratory for analysis. If mold is found in high enough quantities, we will write a protocol that a mold remediation company will have to follow to make sure that it is done correctly without doing too much or too little. 

We will spell out what measures need to be taken to protect the residents and workers from mold exposure, including proper protective clothing, the creation of containment zones with a negative vacuum, and what chemicals to use for cleaning. In addition, we will write a range of pricing that a typical job of that nature costs, so the remediator can’t simply come up with an astronomical number. After the remediation is completed, the mold inspector will return and perform a clearance test to make sure that the remediation was successful, or else the remediator will have to return and continue until his work passes the clearance test.

This way, you don’t have the student grading his own paper or, to put it another way, you don’t have the fox guarding the henhouse. The remediator must comply with the assessor’s protocol (action plan) and pass the clearance test.
